Custom Tap Tag – Terms of Service

Welcome to Custom Tap Tag. By purchasing, activating, or using any Custom Tap Tag product or website, you agree to the following Terms of Service.

1. Acceptance of Terms

By purchasing or using a Custom Tap Tag product, website, or related services, you acknowledge that you have read, understood, and agree to these Terms of Service.

2. Service Description

Custom Tap Tag provides NFC-enabled products that link to online profile pages and other digital content. Customers are responsible for providing accurate information and maintaining the content displayed on their tag pages.

3. Service Availability

While we strive to provide reliable service, we do not guarantee uninterrupted access.

Our website, servers, tag profile pages, or related services may become temporarily unavailable due to:

  • Scheduled maintenance
  • Software updates
  • Server maintenance
  • Hardware failures
  • Internet outages
  • Third-party service interruptions
  • Security incidents
  • Technical issues beyond our control
  • Force majeure events
  • Listings for waterproof and or durablility are not for all Tags. Material used for printing is

Temporary interruptions do not constitute a breach of these Terms.

4. Errors and Corrections

Although we make every effort to provide accurate and reliable service, errors may occur.

These may include but are not limited to:

  • Website errors
  • Incorrect information
  • Display issues
  • Software bugs
  • NFC functionality issues
  • Broken links
  • Pricing or product description errors

We reserve the right to correct any errors, omissions, or inaccuracies at any time without prior notice.

5. Software Updates

Custom Tap Tag may update, modify, improve, or discontinue features of the website or tag management system at any time.

Updates may include:

  • Security improvements
  • New features
  • Bug fixes
  • Performance improvements
  • User interface changes
  • Database maintenance

Some features may change or be removed without prior notice.

6. Tag Page Hosting

Each purchase includes hosting of the associated tag profile page for at least two (2) years from the date of purchase or activation.

By purchasing a Custom Tap Tag, you acknowledge and agree that:

  • Hosting of the tag profile page is guaranteed only for the initial two-year period.
  • After two years, continued hosting may end or require renewal, a subscription, or another hosting option if offered.
  • If hosting is not renewed after the included period, the associated profile page may be disabled, removed, or permanently deleted.
  • Custom Tap Tag is not responsible for lost data after the included hosting period has expired.

7. Customer Responsibilities

You agree to:

  • Provide accurate information.
  • Keep your profile information current.
  • Use the service only for lawful purposes.
  • Not upload illegal, abusive, fraudulent, or harmful content.
  • Not attempt to interfere with or compromise our systems.

You are solely responsible for the information displayed on your tag page.

8. Account Security

If customer accounts are provided, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

9. Privacy

Your use of Custom Tap Tag is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.

10. Limitation of Liability

To the maximum extent permitted by law, Custom Tap Tag shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Loss of business
  • Loss of profits
  • Lost opportunities
  • Data loss
  • Service interruptions
  • Website downtime
  • Delayed access to tag pages
  • Damages resulting from inaccurate customer information

Our total liability shall not exceed the amount paid for the applicable product.

11. No Warranty

Custom Tap Tag products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.

We do not guarantee:

  • Continuous uptime
  • Error-free operation
  • Compatibility with every NFC-enabled device
  • Uninterrupted access
  • Permanent availability of any specific feature

12. NFC Compatibility

Most modern smartphones support NFC technology; however, compatibility varies by manufacturer, model, operating system, software version, and device settings.

Customers are responsible for ensuring their device supports NFC functionality. Custom Tap Tag is not responsible for limitations or changes made by device manufacturers.

13. Prohibited Uses

You may not use Custom Tap Tag services for:

  • Illegal activities
  • Fraudulent purposes
  • Harassment
  • Distribution of malware
  • Spam
  • Copyright infringement
  • Content that violates applicable laws

We reserve the right to suspend or terminate access for violations of these Terms.

14. Changes to These Terms

We may modify these Terms of Service at any time. Updated versions become effective when posted on our website. Continued use of our products or services constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

By purchasing, activating, or using a Custom Tap Tag product or service, you acknowledge that you have read, understood, and agree to these Terms of Service.

17. Order Acceptance and Manufacturing Limitations

All orders are subject to review and acceptance by Custom Tap Tag. We reserve the right to refuse, decline, cancel, or limit any order at our sole discretion.

Many of our products are custom-designed and manufactured using 3D printing technology. Due to the limitations of the design process and 3D printing, some requested designs, models, logos, dimensions, or features may not be printable, may not produce acceptable results, or may require modifications to ensure structural integrity and product quality.

We reserve the right to:

  • Decline orders that cannot be manufactured to our quality standards.
  • Request modifications to submitted artwork or designs.
  • Adjust wall thicknesses, dimensions, or other design elements when necessary for successful production.
  • Cancel and refund an order if a design is determined to be impractical, unprintable, excessively fragile, or otherwise unsuitable for manufacturing.

Customers acknowledge that not every design can be reproduced exactly as submitted due to the physical limitations of 3D printing materials, printer capabilities, and manufacturing processes.

18. Product Materials, Durability, and Water Resistance

Some advertisements, product images, or promotional materials may reference features such as “waterproof,” “weather-resistant,” or “durable.” These descriptions apply only to specific products or materials and should not be interpreted as applying to every Custom Tap Tag product.

Unless otherwise stated, most of our tags are manufactured using PLA, a common 3D printing material. While PLA is suitable for many everyday applications, it is not fully waterproof and may become damaged, warped, or degraded when exposed to excessive heat, prolonged moisture, harsh chemicals, or extended outdoor conditions.

The durability and water resistance of a tag depend on several factors, including:

  • The material selected for printing.
  • The intended use of the product.
  • Environmental exposure.
  • The design and thickness of the printed part.

If you require a tag with increased durability, weather resistance, or water resistance, please contact us before placing your order. We may be able to manufacture your tag using an alternative material better suited for your intended application. Additional charges and production times may apply.

Custom Tap Tag makes no guarantee that every product is waterproof, weatherproof, or suitable for all environments unless expressly stated in the product description or confirmed by us in writing.
